A Record Number of ADA Claims Filed in 2009

In 2009, 21,000 employees claimed their employers violated their rights under the Americans with Disabilities Act (ADA).  This is the highest number of claims brought under the ADA since it came into law 20 years ago.  The increase may be due to a number of factors, including a rise in the number of jobs being cut due to the down economy.  Another significant factor may be the recent expansion of the ADA to cover even more health issues.  Many diseases such as asthma, depression, autism, diabetes, and sometimes possibly cancer in remission (see our recent article here) can be considered a disability if they substantially impair a major life activity.
